These Terms and Conditions of Carriage (“Terms”) govern every shipment tendered to United Express Delivery (“we”, “us”, “the Carrier”) for air, land, sea or door delivery service, within the United States or internationally. By tendering a shipment, booking online or using our tracking tools, the shipper agrees to these Terms on its own behalf and on behalf of the recipient and anyone else with an interest in the shipment.
Definitions
“Shipment” means all packages, documents or freight moving under one tracking code. “Shipper” means the person or business that books the service. “Recipient” means the person or business named as consignee. “Tracking code” means the unique identifier we issue for each shipment.
Shipper Responsibilities
The shipper warrants that the contents are accurately described, properly packed and labeled for the selected mode of transport, and lawful to ship. The shipper is responsible for complete and correct addresses, declared values and any information required by customs or regulatory authorities. Additional charges caused by inaccurate information, including address corrections, re-weighs and storage, will be billed to the shipper.
Prohibited and Restricted Items
We do not accept cash or negotiable instruments, firearms or ammunition, illegal substances, live animals, human remains, or any item whose carriage is prohibited by federal, state or international law. Dangerous goods are accepted only when declared and prepared in accordance with DOT, IATA or IMDG regulations as applicable. We may refuse, hold or return any shipment that we reasonably believe does not comply.
Right of Inspection
We, and government authorities including U.S. Customs and Border Protection, may open and inspect any shipment at any time without notice.
Rates, Invoicing and Payment
Charges are calculated on the greater of actual or dimensional weight and include applicable fuel and accessorial surcharges. Duties, taxes and fees imposed by any government are the responsibility of the recipient unless the shipper has elected to pay them. Invoices are payable within the term stated on the invoice. Unpaid balances may incur a late fee and collection costs to the extent permitted by law.
Delivery and Transit Times
Published transit times are estimates unless a guaranteed service is purchased. We may deliver to the recipient’s address, to a person present at that address, or leave the shipment in a safe location unless signature is required. Delivery may be delayed by weather, customs, carrier capacity, incorrect information or other events outside our control.
Shipment Holds
A shipment may be placed on hold for reasons including incomplete documentation, customs review, an unpaid balance, a failed delivery attempt, an incorrect address or a request from the shipper. The tracking page will display the hold status. Storage charges may apply to shipments held for more than five business days for reasons attributable to the shipper or recipient.
Liability and Declared Value
Unless a higher value is declared and the corresponding charge paid, our liability for loss of or damage to a shipment is limited to US $100 per shipment or the actual value, whichever is less. International air and sea shipments may be subject to the Montreal Convention, the Carriage of Goods by Sea Act or other treaties that further limit liability. We are not liable for indirect, incidental or consequential damages, including lost profits.
Claims
Claims for visible damage must be noted at delivery and submitted in writing within 15 days. Claims for loss or concealed damage must be submitted within 60 days of the shipping date. Original packaging must be retained for inspection. Charges must be paid before a claim is processed and may not be deducted from a claim.
Tracking Information and Privacy
Anyone holding a tracking code can view the full shipment record, including the sender and receiver names and addresses, the destination, the package details, the status and the route. Treat your tracking code like a receipt and share it only with people who need it. Tracking codes are randomly generated and cannot be guessed. We process personal data only to provide and improve our services and as required by law.
Force Majeure
We are not responsible for delay, loss or damage caused by events beyond our reasonable control, including natural disasters, severe weather, acts of government, strikes, civil unrest, epidemics and failures of third-party networks.
Governing Law
These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict of laws principles. Any dispute will be resolved in the state or federal courts located in that state, unless an international convention requires otherwise.
Changes to These Terms
We may update these Terms from time to time. The version published on this page at the time a shipment is tendered applies to that shipment.
